Tried to look up the mark contest but only found a vague reference on Elanthipedia which implies appraisal is used to determine success. Link is attached:

I don't really have a problem with mark, but it is kinda easy mode for the thieves. There's not enough paladin/thief interaction as it is to really even make it an issue. I hope that changes.
